Position Statement of: Safeguarding, Tenants, Visitors and Vulnerable Adult

Joymac Care has a responsibility to protect the Tenants and children, young people or any vulnerable adults who visit the premises. Joymac Care retains the right to have pre-arrangements agreements and sufficient details to enable a risk assessment to be carried out and appropriate Staffing set in place to ensure the safety of all concerned.

Joymac Care’s responsibilities include Staff, visiting tradesmen and other individuals who may have ‘one to one’ access to the Tenants and to ensure that all checks under the Disclosure and Barring Service (DBS) that replaces the old Criminal Records Bureau Service are made. Evidence of this is kept up to date and made available to CQC officials, commissioners or similar authorities when required.

Joymac Care’s insurance arrangements for Public Liability and Employers Liability cover the activities of the organisation to the required level of the complexity of the services provided.

Policy

Joymac Care is mindful of its responsibility towards the Service User’s in general and the impact on the daily lives that any visitors to the premises may have. Whilst accepting that all efforts will be made to accommodate visitors – Joymac Care retains the right to monitor and assess the effect and the outcomes to the general well-being of the Tenants as a group.

Legal Requirements

The Policies and Procedures of Joymac Care in this connection comply with the:

  • Health & Social Care Act 2008 (Regulated Activities) Regulations 2010. Outcome 7 Regulation 11 (Safeguarding people who use the service from abuse)
  • Outcome 13 Regulation 22 (Staffing – sufficient numbers of appropriate staff)
  • Health and Safety at Work Act 1974 (outlining the role and responsibilities of the organisation and individual responsibilities)
  • Management of Health & Safety at Work Act 1999 (requiring risk assessments and control measures to be carried out).

Arrangements for Visitors to Tenants

Joymac Care retains the right to make suitable arrangements for all visitors to the premises and other rights that remain within their duty of care and responsibilities to the Tenants.

Risk assessments will be carried out to ensure that risks are measured for likelihood and possible outcomes. These will be assessed /graded for the risk and control measures set in place. Assessments will be carried out as often as the each situation requires it – or at least annually. If the risk is assessed too high or control measures unachievable – Joymac Care retains the right to refuse to carry out the activities

Arrangements for Visiting Professionals, Tradesmen or Others

Joymac Care will take all measures to ensure that visitors are checked and Staff ensures that visitors have authorised identification or that no ‘one to one’ situation takes place. Checks under the Disclosure and Barring Service will be made for those visitors who might have one to one contact with Tenants. Visitors will sign the Visitors Register Book in reception on their arrival and sign out when they leave.

Arrangements With Commissioning Authorities

Joymac Care is mindful that although it will make all efforts to ensure Visits from family, friends and acquaintances are facilitated – it retains the right to assess each situation under the legal obligations and duty of care to the Tenants.
